Terms of sale

The sale of products is governed by these "General Conditions of Sale" consisting of the following articles.

 
1. The parts.
1.1 Florian Calzature di D'ignazio Floriana, hereinafter "Seller", carries out its e-commerce activity through the online sales site www.floriancalature.it, hereinafter e-commerce, and addresses the "end Consumer" directly.
1.2 "Final Consumer": any natural person who has reached the age of majority who purchases goods from the aforementioned site for non-commercial, resale and/or rental purposes.
1.3 The Seller may make changes or amendments to these "General Conditions of Sale" at any time. Therefore, the customer will be required to accept the "General Conditions of Sale" at the time of purchase.
1.4 The final Consumer, hereinafter the Customer, is requested to carefully read the "General Conditions of Sale" accessible via the links provided and the email that will be sent to the email address after the "order confirmation" following the completion of the purchase procedure.
2. Purchase
2.1

Product sheet : each product is represented by a photograph and is accompanied by a "Product sheet" which contains:

a) Brief Description

b) Potentially purchasable measures

c) Price

d) General Description

e) Reviews
2.1.1 General description : this is a brief description that reports some characteristics of the product. Fancy terms can also be used and in any case not directly referable to the product. The compositions, or the percentages referring to fabrics and materials are those reported on the labels of the products on sale.
2.1.2 Colors and Measurements : the available colors and measurements are reported for purely descriptive purposes. The color describing the availability of the product is not to be considered faithful to reality as it depends on technical factors, such as the resolution of the Customer's video, the difficult reproducibility due to the material the product is made of, etc.
2.1.3 Price: the price shown in the product sheet and in the "catalogue" is the retail price including VAT, excluding transport costs, charges and customs duties relating to the country of origin of the Customer and/or destination of the goods. Florian Calzature di D'ignazio Floriana, reserves the right to change prices at any time and without notice. The prices present at the time of the "Order Confirmation" will be charged to the Customer.
2.1.4 Photo : although the photos are taken with care, it is possible that the photograph does not faithfully represent the product. Consequently, Florian Calzature di D'ignazio Floriana will not be responsible for any inadequacy of the graphic representations of the products shown on e-commerce. The photo is to be considered only as an example . The potentially saleable product will be photographed in a single color.
2.1.5 Reviews: this is a special space where the Customer has the opportunity to write down his experience with the product and share data on quality, fit, etc., giving not only a qualitative judgment, but also a quantitative one through a vote.
2.2 Product selection and cart creation: the product selection is done by choosing the model, the size and then clicking on the "Buy" button. The "Cart" can contain one or more products and can be modified at any time before the "Order Confirmation". Adding to the cart can be done either from the catalog or later from the product sheet.
2.3 Order Confirmation: the order confirmation may take place after acceptance of the "General Conditions of Sale" and the insertion of the information that is essential for the acceptance and shipment of the goods listed in the "Order Confirmation", i.e. the list of products contained in the cart including shipping costs.
2.4

Payment methods : before accepting the order, the Customer must choose one of the following payment methods available on e-commerce:

a) PayPal.

If PayPal is selected, the Customer must follow the procedures on the PayPal website.

b) PostePay

In case of selecting PostePay, the Customer must top up using the coordinates found within the e-commerce. Proof of payment is given by the amount being credited to the Seller's prepaid card. The Seller reserves the right to accept the transmission of the Payment receipt, received via email at info@floriancalature.it, as proof of payment.

Furthermore, such information will never be used by the Seller except to complete the procedures relating to the Customer's purchase and to issue the relevant refunds in the event of any returns of the products, following the exercise of your right of withdrawal, or if it becomes necessary to prevent or report to the police the commission of e-commerce fraud.
2.5 Acceptance of the order : the Seller reserves the right to refuse the order if the Customer has not complied with the purchase procedure, has not accepted the General Conditions of Sale or if he/she does not provide all the data requested for shipping and invoicing or in any case if the payment has not been successful, i.e. in the case of selecting a bank transfer, the amount is not debited within three (3) working days from the date of transmission of the order confirmation to the Seller's current account, in the case of selecting the Pay Pal method, the credit has not been correctly credited to the Seller's account, in the case of selecting the PostePay method, the credit has not been correctly credited to the Seller's prepaid card . The total amount includes the sum of the sales prices and transport costs, depending on the delivery method selected by the Customer, and/or present on e-commerce . Any customs clearance costs are excluded. In case of selecting the "Cash on delivery" payment method, the goods will be sent before receiving the payment. If the final consumer does not accept the cash on delivery payment twice in a row, then any subsequent order from the same consumer will be rejected . The order may be rejected by the Seller, if there are disputes between Florian Calzature di D'ignazio Floriana and the Customer and for any other legitimate reason.
2.6 Order Acceptance: The Customer accepts his order by sending the Order Confirmation, as per Article 2.3, to the Seller electronically. The Order Confirmation is proof of the acceptance of the order by the Customer, including these General Conditions of Sale.
2.8 The Order Confirmation will be stored in our database for the period of time necessary to process the orders and in any case within the terms of the law.
2.9 The language available for concluding the contract with the Seller is Italian.
3 Order processing and product availability.
3.1 Once the contract is concluded, Florian Calzature di D'ignazio Floriana will take charge of your purchase order.
3.2

Product Availability: If the products presented on e-commerce are no longer available or on sale at the time of your last access to e-commerce or when you send the order confirmation, the Seller will inform you promptly and in any case within thirty (30) days from the day after you sent your order to the Seller, of the possible unavailability of the products ordered. In the event of forwarding the order confirmation and payment of the price, the Seller will refund the amount already paid by the Customer.
3.3 By transmitting the Order Confirmation, the Customer declares that he knows and accepts the General Conditions of Sale and the additional information contained in
3.4 Once the contract has been concluded, the Seller will send the Customer by email a receipt of the purchase order, containing a summary of the information already contained in the order confirmation (General Conditions of Sale, Information on the right of withdrawal, information relating to the essential characteristics of the product and detailed indication of the price, payment methods and delivery costs).
4. Product warranties.
4.1 All products are provided with an identification tag. The Customer must not remove the tag from the purchased products, of which they form an integral part.
4.2 The Seller, in the event of the exercise of your right of withdrawal, has the right to not accept the return of products that are missing the relevant tag or that have been altered in their essential and qualitative characteristics or that have been damaged.

6. Right of withdrawal
6.1 The Customer has the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within ten (10) working days, starting from the day of receipt of the products purchased on e-commerce. However, it is not possible to change the chosen item with another. Except in cases where the Seller deems it appropriate to accept the change by the Customer.
6.2 To withdraw from the contract, the customer must use the return form and follow the rules set out in the "Return" section in e-commerce and in points 6.1,6.2,6.3,6.4 of these "General Conditions of Sale".
6.3 The only costs that the Customer must bear are those of returning the purchased products only if you decide to use a different shipping agent than the one indicated by the Seller in the Return Form. If instead you decide to use the shipping agent indicated by the Seller, the costs of returning the products will be at our expense.
6.4 The Right of Withdrawal - in addition to compliance with the terms and conditions described in the previous points 6.1, 6.2, 6.3 - is considered to be correctly exercised if the following conditions are also fully respected:
  1. the Return Form must be correctly completed and sent to the Seller within ten (10) working days of receiving the products;
  2. the products must not have been used, worn, washed or damaged;
  3. the identification tag must still be attached to the products.
  4. Products must be returned in their original packaging,
  5. Returned products must be sent to the Seller in a single shipment
  1. Returned products must be delivered to the courier within ten (10) working days from the date you received the products.
6.5 If the Right of Withdrawal is exercised following the methods and terms indicated in this paragraph 6, the Seller will refund any sums already collected for the purchase of the products.
6.6 The sums will be refunded to the Customer as soon as possible and, in any case, within thirty (30) days from the date on which the Seller became aware of the exercise of the right of withdrawal by the Customer. The Seller will activate the refund procedures, once the correct execution of the terms and conditions indicated above has been verified, as indicated in paragraph 6.
6.7 If the methods and terms for exercising the right of withdrawal, as specified in this paragraph, are not respected, the Customer will not be entitled to a refund of the sums already paid to the Seller or to the issue of the requested credit; however, the Customer, at his own expense, may obtain the products back in the state in which they were returned to the Seller. Otherwise, the Seller may retain the products, in addition to the sums already paid for their purchase.
7. Shipping
7.1 Shipping times: shipping times do not depend on Florian Calzature di D'ignazio Floriana but on the shipping method chosen by the customer during the construction of the Order and the courier with which the purchased goods will be sent. Generally, delivery takes place within three (3) working days in Italy, within seven (7-10) days in Europe and within two-three (2-3) weeks outside Europe. Subject to unforeseen circumstances and customs clearance times. The Seller, however, is not responsible for actual delivery times different from those indicated even if it will implement all necessary actions to respect them.
7.2 Shipping costs: the shipping cost is paid by the Customer and is part of the amount shown in the order confirmation to be paid to the Seller. 8. Refund times and methods
8.1 After the return of the products, the Seller will carry out the necessary checks regarding their conformity. If the checks are concluded positively, the Seller will send the Customer, via email, the relevant confirmation of acceptance of the returned products.
8.2 Whatever the payment method used by the customer, the refund is activated by the Seller as soon as possible and in any case within thirty (30) days from the date on which the Seller became aware of the exercise of your right of withdrawal, after verifying the correct execution of the Customer's right of withdrawal and acceptance of the returned products.
8.3 If there is no correspondence between the recipient of the products indicated in the order form and the person who made the payment of the sums due for their purchase, the refund of the sums, in the event of exercising the right of withdrawal, will be carried out by the Seller, in any case, towards the person who made the payment.
9. Controversies
9.1 These General Conditions are governed by and will be interpreted in accordance with Italian law, including Legislative Decree no. 206 of 6 September 2005 (Consumer Code), with particular reference to Title III [of Part III], Chapter I, Section II of the said Consumer Code, as well as Legislative Decree no. 70 of 9 April 2003 (electronic commerce legislation), without prejudice to any other prevailing mandatory rule of the country of habitual residence of the customer.
9.2 In the event of a dispute, the competent court will be that of Teramo.
9.3 Florian Calzature di D'ignazio Floriana reserves the right to make changes or amendments at any time to these General Conditions of Sale and the Privacy Policy. Such changes or amendments will be effective exclusively in relation to purchase orders submitted after the date of modification or new amendment.
